Plastic the Revolution Terms of Use

1. Agreement to these Terms

These Terms of Use (the "Terms") are a binding agreement between you and Plastic Impact Network LLC, a Wyoming limited liability company ("PIN," the "Company," "we," "us," or "our"), governing your use of the Plastic the Revolution application, website, and related services (collectively, the "Service"). By creating an account, checking the acceptance box at signup, or using the Service, you accept these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

Our Community Guidelines are also incorporated by reference and apply to everything you post and every community and event you participate in.

2. The Service

The Service is a platform for logging plastic cleanup activity, joining communities, listing and RSVPing to in-person cleanup events, and tracking participation through features such as the Impact Score, tiers, and badges. The Service is currently provided free of charge. The Company provides the software platform only. The Company does not conduct cleanups, does not organize events, and does not verify user-reported data.

3. Eligibility and accounts

(a) You must be at least 18 years old and able to form a binding contract to create an account or use the Service. By creating an account, you represent that you are at least 18. The Service is not directed to, and may not be used by, anyone under 18. Section 10.5 describes the only circumstance in which a minor may be present at an event.

(b) You agree to provide accurate registration information and keep it current, to maintain only one account, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at info@plasticimpactnetwork.com of any unauthorized use of your account.

(c) You consent to receive transactional communications from us electronically, such as email verification, password reset, and organizer invitation messages. These are necessary to operate your account.

(d) We may refuse, suspend, or terminate accounts as described in Section 15.

4. Public identity

The Service displays a public identifier (your "Public ID") with your activity, such as on leaderboards and in communities. Your legal name and email address are not displayed publicly by the Service. Content you post, your Public ID, your impact figures, and your badges and tier may be visible to other users and, where features allow, to the public.

5. Acceptable use

You agree that you will not:

(a) use the Service for any unlawful purpose or in violation of these Terms, the Community Guidelines, or applicable law;

(b) harass, threaten, defame, or harm any person, or post content that does so;

(c) submit false, inflated, duplicated, or fraudulent cleanup logs, weights, or other data, or otherwise manipulate the Impact Score, tiers, badges, or leaderboards;

(d) impersonate any person or entity or misrepresent your affiliation with any person or entity;

(e) post or transmit content that infringes any intellectual property, privacy, publicity, or other right of any person;

(f) advertise, solicit, or promote any product, service, fundraising effort, or financial opportunity without our prior written permission, including any cryptocurrency, token, digital asset, security, or investment of any kind;

(g) collect or harvest information about other users, or post another person's personal information without that person's consent;

(h) upload viruses or malicious code, or interfere with, disrupt, probe, or circumvent the Service, its security features, or its moderation systems;

(i) scrape, copy, or access the Service through automated means except as we expressly permit;

(j) reverse engineer or attempt to extract the source code of the Service, except to the extent this restriction is prohibited by law; or

(k) use the Service to plan, promote, or encourage any activity that is dangerous, unlawful, or harmful.

6. Your content

(a) "Your Content" means content you submit to the Service, including cleanup logs, weights and impact data, photos, community and event names, descriptions, posts, and display text.

(b) You retain ownership of Your Content. You grant the Company a non-exclusive, worldwide, royalty-free license, with the right to sublicense to our service providers, to host, store, reproduce, technically modify (for example, resizing images or removing metadata), publish, publicly display, and distribute Your Content for the purposes of operating, improving, securing, and promoting the Service. This license ends when Your Content is deleted from the Service, except (i) to the extent Your Content has been shared with others who have not deleted it, (ii) for copies held in routine backups for a limited period, and (iii) for records we retain as described in the Privacy Policy.

(c) You represent and warrant that you own Your Content or have the rights necessary to grant the license above, and that Your Content and our permitted use of it do not violate any law or the rights of any person. For photos, you represent that identifiable people in the photo have consented to its posting, and that any identifiable minor appears with the consent of the minor's parent or legal guardian.

(d) We do not undertake to pre-screen content, but we may review, restrict, remove, or refuse any content at any time, including through our moderation review process, and may suspend or terminate accounts for violations. To report content, use the in-app reporting tools or contact info@plasticimpactnetwork.com.

7. Photos and metadata

When you upload a photo, the Service automatically removes embedded metadata, including GPS location data (EXIF), before the photo is stored. Do not rely on metadata surviving upload for any purpose. Metadata removal does not change what is visible in the image itself. You remain responsible for the visible content of photos you upload, including faces, house numbers, license plates, and other identifying details.

8. Self-reported data; no verification

Cleanup logs, weights, material counts, and other impact figures on the Service are self-reported by users. The Company does not independently verify them. Impact figures may be inaccurate, incomplete, estimated, or duplicated, and are provided for community engagement and motivation only. We may, but are not obligated to, review, adjust, cap, or remove entries we suspect are inaccurate, duplicative, or fraudulent, and we may recalculate scores and leaderboards accordingly.

Impact figures on the Service are not verified environmental data. They may not be relied on as, or used to support, any environmental credit, offset, certification, regulatory filing, marketing or advertising claim, or scientific conclusion. If you republish impact figures from the Service, you must identify them as self-reported and unverified.

9. Impact Score, tiers, and badges have no monetary value

The Impact Score, tiers, badges, and any similar participation features (collectively, "Engagement Features") exist solely to recognize participation and encourage cleanup activity. Engagement Features:

(a) are not money, currency, virtual currency, cryptocurrency, tokens, digital assets, securities, financial instruments, rewards, prizes, or property of any kind;

(b) have no cash or monetary value and cannot be redeemed for cash, goods, services, or anything of value;

(c) cannot be purchased, sold, transferred, assigned, exchanged, pledged, or inherited; and

(d) may be recalculated, adjusted, reset, suspended, or discontinued by the Company at any time, without notice or liability, and create no property interest, entitlement, or expectation of value of any kind.

The Service contains no payment functionality, no purchases, no rewards program, and no integration with any cryptocurrency, token, or blockchain asset. The Company does not offer, sell, distribute, or promise any digital asset through the Service. No person or entity is authorized to offer, promise, or distribute any payment, reward, token, or digital asset in connection with the Service or your activity on it. Any statement to the contrary is unauthorized and should be reported to info@plasticimpactnetwork.com.

10. Communities and in-person events

10.1 The Company is a platform, not an organizer

The Service allows community owners and their designated organizers ("Hosts") to list in-person events, such as cleanups, and allows users to RSVP to them. The Company provides listing and RSVP tools only. The Company does not organize, operate, host, sponsor, supervise, manage, inspect, or insure any event; is not present at events; does not vet, screen, or run background checks on any Host or attendee; and does not verify that a Host has obtained any permit or permission. Your interactions at events are with other users, not with the Company, and are at your own risk.

10.2 Host responsibilities

If you create an event, you agree that you: (a) are organizing the event voluntarily; (b) are solely responsible for planning, organizing, communicating about, and supervising the event; (c) will select a lawful and reasonably safe location and obtain all permissions, permits, and approvals required for the location and activity; (d) will describe the event accurately, including known hazards; (e) will not knowingly expose attendees to unreasonable danger; (f) will comply with all applicable laws, including any that govern minors, traffic, waterways, and waste handling; and (g) will complete the Host acknowledgment presented at event creation. You remain responsible for your event even if you delegate tasks to others.

10.3 Attendee assumption of risk

Cleanup and other in-person events involve inherent risks, including but not limited to: uneven, slippery, or unstable terrain; weather; traffic and proximity to roads; water and drowning hazards; sharp, broken, contaminated, or hazardous objects and materials; wildlife, insects, and plants; strenuous physical activity; and the acts or omissions of Hosts, attendees, and third parties. By RSVPing to or attending an event, you acknowledge these risks, confirm that your participation is voluntary, and, to the fullest extent permitted by applicable law, knowingly and freely assume all risk of injury, illness, death, and property damage arising out of the event. You are responsible for your own health decisions, protective equipment (such as gloves and appropriate footwear), and compliance with law and posted rules.

10.4 Release

To the fullest extent permitted by applicable law, you release and discharge the Company and its members, managers, officers, employees, and agents (the "Released Parties") from any and all claims, liabilities, damages, and causes of action arising out of or relating to any event listed on the Service, including claims based on the acts or omissions of a Host or another attendee, except to the extent caused by a Released Party's own gross negligence or willful misconduct.

10.5 Events are for adults

Only account holders, who are 18 or older, may RSVP to or attend events. Events on the Service are for adults. You agree not to bring a minor to an event. Hosts and the Company may exclude any person under 18. We may introduce supervised participation by minors accompanied by a parent or legal guardian in a future update; until we do, and until any additional terms for that participation are presented and accepted, events remain adults-only.

10.6 Emergencies

The Company cannot dispatch or provide emergency assistance. In an emergency, contact local emergency services immediately.

10.7 Event acknowledgments

Creating an event or RSVPing to one requires completing the acknowledgment presented at that step. Those acknowledgments summarize, and do not replace, this Section 10.

11. Intellectual property; feedback

The Service, including its software, design, text, graphics, logos, the Plastic mascot character, and all related intellectual property, is owned by the Company or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose in accordance with these Terms. No other rights are granted. If you send us feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation to you.

12. Copyright complaints

We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act. Send notices to our designated agent: Copyright Agent, Plastic Impact Network LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA, info@plasticimpactnetwork.com. We may remove content alleged to be infringing and may terminate the accounts of repeat infringers. If you believe your content was removed in error, you may send a counter-notice to the same address.

13. Third-party services and links

The Service may contain links to third-party websites or rely on third-party services. We are not responsible for third-party content, services, or practices.

14. Privacy

Our Privacy Policy describes how we collect, use, and share information. By using the Service, you agree to it.

15. Termination

You may stop using the Service at any time and may delete your account in Settings > Account > Delete Account or by emailing info@plasticimpactnetwork.com. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, the Community Guidelines, or applicable law, to protect users or the Service, or if we discontinue the Service. Sections 6(b) (to the extent stated there), 8, 9, 10.3 through 10.5, 11, and 16 through 21 survive termination.

16. Disclaimer of warranties

THE SERVICE, ALL CONTENT ON IT, AND ALL EVENTS LISTED ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WITHOUT LIMITING THE FOREGOING, THE COMPANY MAKES NO WARRANTY REGARDING THE ACCURACY OF USER-REPORTED DATA, THE CONDUCT OF ANY USER OR HOST, OR THE SAFETY, LEGALITY, OR QUALITY OF ANY EVENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) THE COMPANY AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE ARISING OUT OF EVENTS OR INTERACTIONS BETWEEN USERS, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) THE TOTAL AGGREGATE LIABILITY OF THE COMPANY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNTS YOU PAID THE COMPANY FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. THESE LIMITATIONS ARE A FUNDAMENTAL BASIS OF THE BARGAIN FOR A SERVICE PROVIDED FREE OF CHARGE.

18. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its members, managers, officers, employees, and agents from and against all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) Your Content; (b) any event you create, host, organize, or attend, including personal injury or property damage occurring at it; (c) your violation of these Terms, the Community Guidelines, or applicable law; or (d) your violation of the rights of any third party.

19. Dispute resolution; governing law

(a) Informal resolution first. Before filing a claim, you agree to contact us at info@plasticimpactnetwork.com with a written description of the dispute and give us 30 days to try to resolve it informally.

(b) Arbitration. Except as provided in (c), any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis, before a single arbitrator, in Wilmington, North Carolina or remotely by agreement. Judgment on the award may be entered in any court of competent jurisdiction.

(c) Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.

(d) Class action and jury waiver. All claims must be brought in the parties' individual capacities, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. To the extent a claim proceeds in court, both parties waive the right to a jury trial.

(e) Opt-out. You may opt out of the arbitration and class waiver provisions in (b) and (d) by emailing info@plasticimpactnetwork.com within 30 days of first accepting these Terms, stating your name, Public ID, and intent to opt out.

(f) Governing law and venue. These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Any matter not subject to arbitration will be brought exclusively in the state or federal courts located in New Hanover County, North Carolina, and you consent to their jurisdiction.

20. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable advance notice, such as by email or in-app notice, and will update the effective date above. Changes apply going forward. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of them. If you do not agree to updated Terms, stop using the Service and delete your account.

21. General

These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and the Company regarding the Service. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will remain in effect. Our failure to enforce a provision is not a waiver of it. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets; you may not assign them. There are no third-party beneficiaries of these Terms except the Released Parties under Section 10.4 and the indemnified parties under Section 18. We are not liable for delay or failure caused by events beyond our reasonable control. Headings are for convenience only, and "including" means "including without limitation."
